Since the Supreme Court of New Jersey decided the Quinlan case a quarter of a century ago, three American Supreme Court decisions and a host of state appellate decisions have addressed end-of-life issues. These decisions, as well as legislation addressing the same issues, have prompted a torrent of law journal articles analyzing every aspect of end-of-life law. In recent years, moreover, a number of law review articles, many published in this journal, have also specifically addressed legal issues raised by palliative (...) care. Much less is known in the United States, however, as to how other countries address these issues. Reflection on the experience and analysis of other nations may give Americans a better understanding of their own experience, as well as suggest improvements to their present way of dealing with the difficult problems in this area.This article offers a conceptual and comparative analysis of major legal issues relating to end-of-life treatment and to the treatment of pain in a number of countries. The Polish society has perceived privatization as an issue of special importance which enables a free market economy in a short time. Privatization has always raised hopes and expectations. It is the lack of experience in the field of ownership transformations, the level of their complexity and the economic, legal, psychological and other conditionings that have confronted those transformations with many hindrances. They have also raised numerous moral and ethical dilemmas among the staff of privatized companies and founding organs including (...) the staff of the Voivodship Council of Łódź. The decisions of the Working Board of one company about the future path of privatization have raised concerns among the staff uncertain of the fate of their place of work. In such cases the voice of the staff, which previously contributed to the company’s financial status, has always been decisive when choosing the path of privatization; this concerns mostly workers’ partnerships. It was John Paul II’s words about people of conscience who are needed in Poland, which were said in Skoczów, that were crucial for privatization decisions by the Voivodship Council of Łódź. (shrink)

The author of the article begins with a discussion of how specialists in the field understand the term “autobiography” and what its role is. Then, she presents the results of an analysis of autobiographical elements present in texts by 136 students starting Polish studies. In analysing the collected works, she diagnoses the places and attitudes of students who referred to stories from their own school lives, their considerations about their teachers’ ways of perceiving pupils, and the purpose of such texts. (...) She also indicates the roles of emotions and the recollections of the personal past in creating school memories, and developing various ways of thinking about pupils, teachers, and literature. In treating those texts as diagnoses of the problems of school and school Polish education, she discusses the importance of such observations for their authors, readers and for school and university education. Typology of perpetrators of domestic violence The objective of the research conducted by the author was to obtain an answer to the question: could we distinguish different types of intrafamily violence perpetrators considering a specified profile of personality factors and temperament traits and how domestic violence perpetrators cope with stressful situations? The research was conducted on a group of 325 men who were convicted pursuant to article 207§1 & 2 of harassment over family members. In terms of a gender the (...) group was homogenous. On the basis of the literature on the subject, the following personality traits of violence perpetrators were categorised: locus of control, self-acceptance, aggressiveness, hostility, intelligent quotient and temperament traits. The following research techniques were employed in the study: the Wechsler Intelligence Scale, Berger's Self-Acceptance Scale, the Delta Questionnaire by R. Drwal, the SABD Questionnaire - Buss-Durkee, Formal Characteristics of Behaviour - Temperament Inventory by J. Strelau, the WCQ questionnaire by R.S. Lazarus and S. Folkman, a categorised interview and an analysis of court records. As a result of the analysis conducted on a group of the studied sample of violence perpetrators, four subgroups, differing in terms of selected personality traits, were specified. They are reactively aggressive perpetrators, perpetrators of low preventive competences, psychopathic and retaliatory perpetrators and perpetrators with a big adaptive potential. Further on, four distinguished groups have been characterised in terms of stress-coping strategies, and psychological processes of coping with stress proceeded differently in the research group. The paper concerns the science of colors (die Farbenlehre) on which among others J.W. Goethe and W. Ostwald were focused. The first part of this essay describes the science of colors in the period from antiquity to late Renaissance. In the pre-scientific phase it was intervened with philosophical speculations as well with symbolism of magic, religions and customs. Since Newton’s time there are distinguished the colors of light and the colors of objects. J.W. Goethe’s Farbenlehre, discussed in the second part, (...) connects empirical studies and metaphysical vision of the light and colors. W. Ostwald, a distinguished chemist and philosopher-energetist, attempted to construct measurable Farbenlehre. He is a creator of a strict colors’ taxonomy, but his soul of artist (he was also a painter) “crept into” his study of colors. Artykuł omawia problemy związane z użyciem słowa pomoc w odniesieniu do tych działań lekarzy, które obejmują leczenie i ratowanie życia. Autorki rozważają rozmaite modele relacji lekarz–pacjent na tle szeroko podzielanych wartości obecnych we współczesnych, pluralistycznych społeczeństwach liberalnych. Autorki twierdzą, że wypełnianie obowiązków lekarza, które są określone w umowie z pacjentem, nie wymaga działań altruistycznych i że wobec tego nie można go nazwać pomocą. Termin ten można jednak poprawnie zastosować do tych specjalności medycznych, w których pacjenci są szczególnie podatni na skrzywdzenie (...) oraz w długoterminowej opiece medycznej. W takich dziedzinach medycyny moralnie dobra praktyka polega na gotowości do wykraczania poza obowiązki kodeksu medycznego. Gotowość taka wyraża się w trwałej dyspozycji do działania dla dobra pacjentów, a nawet w gotowości do poświęcenia części własnego dobra. (shrink)

Recent years in Poland have been characterized by the dynamic development of scientific activity among nurses. It might have been caused by several factors, namely: the rising needs and expectations of representatives of this professional group, the necessity of adjusting to EU standards, changes in the system of education, as well as the individual “research needs” of those representatives. However, is there a correlation between the increase in the quantity of scientific research and its quality? An attempt to answer that (...) question led the author to formulate this paper’s goal, which had been formulated as follows: to analyse different sources of information concerning the reality of scientific research in nursing in Poland. Willing and Understanding elucidates a variety of issues in and approaches to debating the will-intellect interplay in the late Middle Ages. Authored by prominent scholars in the field, the contributions offer different perspectives on the development of late medieval theories of the will. Internet jest przestrzenią, która otworzyła nowe możliwości prezentowania dziedzictwa kulturowego. Wraz z rozwojem sieci użytkownicy zyskali dostęp do cyfrowych kopii książek, dzieł sztuki oraz wizualizacji 3D zabytkowych budowli i całych miast. Kontakt z kulturą za pośrednictwem mediów nigdy wcześniej nie był tak łatwy. Trudno nie docenić tych możliwości, szczególnie mając w pamięci niedawne czasy pandemii, kiedy to kontakt z kulturowym dorobkiem człowieka ograniczał się głównie do form online. Zasoby online to ogromny rezerwuar materiałów wszelkiego typu, z którego użytkownicy wybierają zazwyczaj (...) te odpowiadające ich zainteresowaniom i preferencjom. Na stronach i platformach internetowych można znaleźć bogaty wachlarz multimediów, tekstów, zdjęć, filmów, symulacji i rekonstrukcji, materiałów związanych z każdym okresem kulturowej i artystycznej działalności człowieka. Różne są też źródła, z których zostały one zaczerpnięte. Duża część materiałów to cyfrowe kopie dzieł sztuki, skany manuskryptów, starodruków, starych fotografii i filmów, udostępnione na oficjalnych stronach instytucji kultury: muzeów, bibliotek czy archiwów. Jeszcze liczniejszą grupę stanowią zasoby, które zostały udostępnione w Internecie w efekcie spontanicznych, oddolnych praktyk jego użytkowników, udostępniających materiały pochodzące z ich prywatnych zbiorów. Są to m.in. zdjęcia wykonane eksponatom muzealnym, pomnikom i zabytkom, a także filmy kręcone w historycznych miejscach. Celem artykułu jest zwrócenie uwagi na problem prezentacji w cyberprzestrzeni treści związanych z dziedzictwem kulturowym oraz korzyści, jakie płyną z digitalizacji zasobów dziedzictwa kulturowego1. Rzadko zwraca się przy tym jednak uwagę na zagrożenia związane z rozpowszechnianiem tych materiałów online. Te same technologie, które pozwalają na prezentowanie obiektów kulturowych w cyfrowych mediach, prowadzą często do przedstawień daleko odbiegających od ich oryginalnego wyglądu, a czasem – do dekontekstualizacji. Zbyt duże zaufanie do możliwości współczesnej technologii może w efekcie prowadzić do degradacji kultury. W tekście przedstawiono przykłady podstawowych problemów związanych z tym zagadnieniem. Interactive media create a space conducive to development of participatory culture, in which media content recipients become its active creators. Participant activities are not limited to commenting on online articles or being active on social media. They want to influence reality through their actions and to participate in creating and spreading information. The willingness and readiness of Internet users to co-create content is becoming increasingly important also in scientific projects, where success depends on the involvement of many volunteers who undertake (...) specific tasks. Although such projects are often time-consuming, they usually do not require advanced skills from the people involved. The only payoff for their efforts is the satisfaction that comes from participating, as well as the recognition in their community. The purpose of this paper is to attempt to evaluate the phenomenon of crowdsourcing in humanities, especially in the context of the new reality created by the Covid-19 pandemic. It is based on the literature which addresses the importance of crowdsourcing in projects in a variety of areas, on top of an analysis of examples in which this method is used. The selection of presented examples is strongly intended to demonstrate the enormous possibilities and resulting benefits of involving willing volunteers in humanities projects. Their role is not diminished by the fact that they do not have competencies related to project topics. It can be assumed that crowsrourcing will be more and more widely used by researchers, especially in times when increasing numbers of people undertake online activities. (shrink)

J. Such first introduced the notion of „complementary experiments”, referring to the decisive situations in science. The similar notions appears in the discussions of new experimentalists. For example, I. Hacking writes about complementarity of different types of microscopy, A. Franklin distinguishes technically good and conceptually important experiments, and P. Galison analyses examples of complementarity of two different approaches to the problem of cosmic radiation. In the article the notion of „complementarity” is extended as to cover the cases of complementarity of (...) method, complementarity of scientific teams etc. As an illustration it is used the case of discovering new type of carbon - called „fulleren”. This volume discusses the definitional problems and conceptual strategies involved in defining the human. By crossing the boundaries of disciplines and themes, it offers a transdisciplinary platform for exploring the new ideas of the human and adjusting to the dynamic in which we are plunged. The emerging cyborgs and transhumans call for an urgent reconsideration of humans as individuals and collectives. The identity of the human in the 21st century eludes definitions underpinned by simplifying and simplified dichotomies. Affecting all the (...) spheres of life, the discoveries and achievements of recent decades have challenged the bipolar categorizations of human/nonhuman and human/machine, real/virtual and thus opened the door to transdisciplinary considerations. Ours is a new world where the boundaries of normality and abnormality, a legacy of the long history of philosophy, medicine, and science need dismantling. We are now on our way to re-examine, re-understand, and re-describe what normal-abnormal, human-nonhuman, and I-we-they mean. We find ourselves facing what resembles the liminal stage of a global ritual, a stage of being in-between—between the old anthropocentric order and a new position of blurred boundaries. The volume addresses philosophical, bioethical, sociological, and cognitive approaches developed to transcend the binaries of human-nonhuman, natural-artificial, individual-collective, and real-virtual. What does it mean to be human? This question has made a meteoric career for itself, becoming a focal point of almost every thread of the transhumanist debate. Significant as it is, the question eludes any definitive answer, since it directly engenders an array of related queries. This Special Issue questions our notions of the human being, human subjectivity, superiority and uniqueness, which tend to be underpinned by simplistic and simplifying dichotomies entrenched in western philosophy, science and art. Eclipsed by (...) the hierarchical vision of the world and dualistic metaphysics, the concept of the nonhuman (regardless of its biological form or ontological status) has always been dependent on its paring element (the human) losing its own significance and independent status. By articulating the problems we face in understanding and defining the human and the nonhuman, this Special Issue offers an insight into the current transhumanist discourse. Crossing the boundaries of disciplines and definitions, the contributors propose an assemblage of methodological and conceptual scaffoldings to build on in this project. They seek new ways and analytical strategies to advance the notions of ‘being one and many’ and ‘being-with’, and in doing so, they envision a new world where forging relations and co-existence with nonhuman agents lie at the core of human experience. This paper explores the relationship between philology and literary criticism and history via two -marital problems drawn from Augustine’s life. The first is historiographical and concerns Augustine’s relations with Anonyma I, his African concubine, who was featured so famously in the Confessiones. My argument, first published in 2002, that Augustine painted his separation from her in the language of Genesis and saw her as a virtual wife, has not found favor with historians. The episode is used as a test case (...) for comparing the historiographical technique of three Augustine biographers. I revisit my reasoning, showing how, sadly, philology and history have grown apart, a phenomenon which, in turn, highlights the need for an increased awareness of and engagement with philology by historians. Philological arguments must be faced and not simply ignored or cherry-picked ad lib. The second problem is historical and prosopographical. Who was the fornicating widower of Epistula 259? In part, I use philological and literary techniques to argue that this widower was indeed Romanianus, and that this letter needs to be dated much earlier than previously thought—even to as early as 396 and the period of Augustine’s co-episcopacy. The tone of the letter is key to understanding it properly. In it, we see an affectionate, urbane, and witty Augustine. (shrink)

In the paper we are analyzing the Polish ART market. It can be noticed that the lack of legal regulation has resulted in many discrepancies among the policies adopted by various ART agencies. The social acceptance of ART procedures available mostly in private clinics led to growing commercialization of the Polish ART market. Additionally, the language of gift and altruistic rhetoric that are overwhelmingly employed by ART agencies reveals hypocrisy of the Polish ART market.

The paper is focused on some aspects of experimental realism of Ian Hacking, and especially on his manipulability criterion of existence. The problem is here related to chemical molecules, the objects of interest in chemical research. The authors consider whether and to what extent this criterion has been applied in experimental practice of chemistry. They argue that experimentation on is a fundamental criterion of existence of entities in chemistry rather than experimentation with. Some examples regarding studies of structures of complex (...) compounds, taken from organic chemistry, are presented to support the authors' considerations. Chemists' laboratory practice depends strongly on the way that representations of entities on (or with) the experiments are used. The authors show that this point has not been given sufficient attention by the new experimentalists. (shrink)

It seems interesting to find out how the situation of the Polish ART practice is reflected in the medical students’ opinions. To answer this question we carried out a two-stage research adopting a data-driven methodology based upon the grounded theory, in which we collected a mixture of quantitative and qualitative data. Our study has revealed students’ high acceptance of IVF and most of the additional procedures, except for IVF in the case of women over 40 and postmenopausal ones. The students’ (...) main concerns were to be compatible with what is presented in medical literature and commonly accepted in medical practice, so the core categories they focused on in their argumentation were medical evidence and medical standards. Whereas the students were consistently trying to ground their reasoning on medical knowledge, their opinions reflected not only statements based on hard data, but also some gender stereotypes hidden in medical literature. In December 2014, Physicians for Human Rights released their analysis of the summary of the Committee Report of the Central Intelligence Agency’s Detention and Interrogation Program. PHR focused on the involvement of health care professionals in the CIA torture program, concluding that the health professionals’ commissions and omissions violated the prescriptions of many fundamental bioethical documents, including international declarations of bioethics and medical research ethics. The medical doctors’ involvement evokes some thoughts concerning bioethical education. It seems that instead of developing (...) virtues through practicing morally good habits, the experience of clinical training undermines the moral ideals that medical students identified themselves with at the commencement of their medical education. The hostile response they sometimes get from their mentors when trying to question morally troubling situations may shape the habit of ‘turning a blind eye’ to unethical behaviour, since the students do not want to jeopardize their grades and future medical career. Maybe it was the development of this habit and the failure to develop the habit of moral courage instead that prevented the medical doctors participating in torture programs from defending moral ideals of their profession more effectively. The main purpose of the paper is to describe, diagnose and interpret mutual rela-tions between the idea of economic freedom and the sense of responsibility for the common good in modern societies functioning in the system of a free market economy. The starting point for the analysis is a reference to predominating scientific discourses and their appearance in the public sphere. These discourses also take up the problem of mutual relations between freedom and responsibility, including responsibility for the common good. (...) One specific case of the relation between units and the widely understood common good, including units engaged in economic activity, is their relation to more operational public goods. Therefore, starting from conclusions based on a probing research concerning Polish society’s attitude towards public goods (which is an index of public morality), we will try to prove that an oversimpli-fied and highly ideological understanding of economic freedom can lead to a) perception of market activities’ results in strictly economic categories, b) atrophy of priority values for each society such as the sense of responsi-bility and common good. Therefore the main thesis of the paper can be seen as the following state-ment: for each economic organization to perform correctly, it must be socially embedded in a defined axio-normative order. Economic order is a part of social order while freedom, as the leading objective idea, cannot be treated either in purely scientific or ideological categories. (shrink)

The concept of the quality of life: The medical and the bioethical aspectThe concept of the quality of life initially contained mainly objective indicators. It was only later that it was extended so as to include the subjective ones as well. Upon its transfer from its original medical context into the social sciences, the concept of the quality of life has inspired a new approach to sick persons. It is now acknowledged that it is not enough to merely prolong a (...) life. It also has to meet the standards generally recognized by active, healthy people. In the assessment of the quality of life both objective state of human health and socio-economic status and subjective satisfaction with life and perception of each other indicators are used. It is used, among other things, to evaluate the effects of medical and non-medical health care and medical intervention. In bioethics, it is noted that the term diminishes the value of human life. The methods used to assess the value of human life based on economic analysis and the measuring of the quality of life can lead to undesirable consequences. Conclusion: on the one hand, the estimation of the quality of life is imminent for various reasons; on the other hand, however, it raises ethical objections. (shrink)

The spectacular progress in assisted reproduction technology that has been witnessed for the past thirty years resulted in emerging new ethical dilemmas as well as the revision of some perennial ones. The paper aims at a feminist approach to oocyte and spare embryo donation for research. First, referring to different concepts of autonomy and informed consent, we discuss whether the decision to donate oocyte/embryo can truly be an autonomous choice of a female patient. Secondly, we argue the commonly adopted language (...) of gift is misleading and that calling for altruism could put female patients at risk of exploitation. Finally, we point out that the presence of gender stereotypes in the procreative area casts doubt whether even a more robust notion of informed consent manages to overcome this risk. (shrink)

Respecting and protecting the confidentiality of data and the privacy of individuals regarding the information that they have given as participants in a research project is a cornerstone of complying with accepted research standards. However, in longitudinal studies, establishing and maintaining privacy is often challenging because of the necessity of repeated contact with participants. A novel internet-based solution is introduced here, which maintains privacy while at the same time ensures linkage of data to individual participants in a repeated measures design. (...) With the use of the anonymous repeated measurements via email (ARME) procedure, two separate one-way communication systems are established through ad hoc email accounts and a secure study website. Ryszard Kilvington jako jedyny ze szkoły tzw. Kalkulatorów Oksfordzkich napisał komentarz do Etyki nikomachejskiej Arystotelesa. Powstałe w 1332 r. Kwestie do Etyki są jednak komentarzem niestandardowym z kilku powodów. Po pierwsze, Kilvington wbrew przyjętej tradycji komentowania Etyki nikomachejskiej nie odnosi się do wszystkich ksiąg ani zagadnień dzieła Stagiryty. Po drugie, wybrane zagadnienia traktuje z różnym zainteresowaniem — niektóre analizuje niezwykle wnikliwie, innym poświęca znacznie mniej miejsca. Po trzecie, w komentarzu na niespotykaną wręcz skalę wykorzystuje argumentację zaczerpniętą z obszaru logiki i (...) filozofii przyrody oraz stosuje procedury badawcze standardowo wykorzystywane w traktatach logicznych, jak i tych dotyczących filozofii przyrody. Pozwala mu to na przyjęcie nader oryginalnej perspektywy w analizach problemów etycznych. W artykule wskazuję na strukturę komentarza oraz charakterystyczny dla tego tekstu układ kwestii, omawiam specyfikę argumentacji wykorzystywanej w Kwestiach do Etyki oraz analizuję wykorzystywane przez Kilvingtona procedury badawcze, takie jak rachunek proporcji, metoda secundum imaginationem oraz rozróżnienie sensów simpliciter i secundum quid, wskazując na ich zastosowanie w dyskursie etycznym.
